These Terms & Conditions (“Terms”) govern your use of the website operated by Embers & Atlas Catering (“Company,” “we,” “us,” or “our”) and the provision of our catering services. By accessing our website or engaging our services, you agree to be legally bound by these Terms.

1. Services

We provide catering and related services subject to availability, written confirmation, and payment terms. All quotations are estimates and subject to change until confirmed in writing.

2. Bookings & Payments

  • A deposit, as specified in your invoice, is required to secure a booking. No services are guaranteed without such deposit.

  • Final payment is due in accordance with the invoice terms.

  • Failure to pay within the specified timeframe may result in cancellation of services without liability to us.

  • Cancellations by the client may incur fees, including forfeiture of deposits, as set forth in your booking confirmation.

3. Client Responsibilities

  • The client must provide accurate event details, including but not limited to location, timing, dietary requirements, and guest numbers.

  • The client is solely responsible for communicating all allergies and dietary restrictions. While we make reasonable efforts, we cannot guarantee the complete absence of allergens.

4. Use of Website

  • You agree not to misuse, disrupt, or attempt unauthorized access to our website.

  • All content, including text, images, logos, and designs, is the intellectual property of Embers & Atlas Catering and may not be used without prior written consent.

5. Limitation of Liability

  • To the maximum extent permitted by law, Embers & Atlas Catering shall not be liable for indirect, incidental, special, or consequential damages arising out of the use of our services or website.

  • Our total liability shall not exceed the amount paid by you for the specific services giving rise to the claim.

6. Indemnification

You agree to indemnify and hold harmless Embers & Atlas Catering, its employees, and agents from any claims, damages, or expenses arising from your use of our services or website, except to the extent caused by our gross negligence or willful misconduct.

7. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of British Columbia. Any disputes shall be subject to the exclusive jurisdiction of the courts located within British Columbia

8. Amendments

We reserve the right to amend these Terms at any time without prior notice. The most current version will be posted on our website. Your continued use of our website or services constitutes acceptance of the updated Terms.

9. Cancellation & Refund Policy

  • Client-Initiated Cancellations

    • All cancellations must be submitted in writing to Embers & Atlas Catering.

    • Deposits are non-refundable.

    • If cancellation occurs more than 30 days prior to the event date, any payments made beyond the deposit will be refunded.

    • If cancellation occurs 15–30 days prior to the event date, 50% of the total event cost (including the deposit) is non-refundable.

    • If cancellation occurs less than 14 days prior to the event date, the client is responsible for 100% of the total event cost.

  • Company-Initiated Cancellations

    • In the rare event that we must cancel due to circumstances within our control, a full refund of all monies paid (including deposit) will be issued, and we will make reasonable efforts to assist the client in finding an alternative caterer.

  • Force Majeure

    • If the event cannot proceed due to circumstances beyond the reasonable control of either party (including but not limited to natural disasters, government restrictions, pandemics, or acts of God), the Company may, at its sole discretion:

      • Apply payments already received as a credit toward a rescheduled event within 12 months; or

      • Refund amounts paid beyond the non-refundable deposit.

  • Refund Processing

    • Approved refunds will be processed within 14 business days to the original method of payment, unless otherwise agreed.
